MyMixue-TMS (hereinafter referred to as “MyMixue-TMS” or “we”) has formulated this MyMixue-TMS Privacy Policy (hereinafter referred to as “this Policy”) and hereby reminds you: this Policy applies only to the products and services of MyMixue-TMS, and does not apply to services provided to you by other third parties, nor does it apply to products or services within MyMixue-TMS that have separate privacy policies. Meanwhile, we are committed to protecting the security of your personal information in accordance with this Policy and relevant laws and regulations, including the Decree on Personal Data Protection of Vietnam.

The formulation and implementation of this Privacy Policy are based on the following principles: the Principle of Accountability, the Principle of Specific Purpose, the Principle of Informed Consent, the Principle of Data Minimization, the Principle of Security Assurance, the Principle of Data Subject Participation, and the Principle of Openness and Transparency. In addition, we will comply with relevant personal data protection laws and regulations in Vietnam to ensure that the processing of personal information is lawful, secure, and transparent.

Part I: Definitions

MyMixue-TMS: Refers to the MyMixue-TMS mobile application (including both iOS and Android versions).

MyMixue-TMS Service Provider: Refers to the provider of the MyMixue-TMS mobile client and software technology services — Zhengzhou Baodao Technology Co., Ltd.

Personal Information: Refers to any information related to a specific natural person that can directly or indirectly identify the identity of that individual.

 

  1. MyMixue-TMS does not sell or rent your personal information to any party, unless with your prior consent or under circumstances permitted by this Policy. Likewise, we do not purchase or trade any user’s personal information.
  1. MyMixue-TMS strictly prohibits any third party from collecting, using, disclosing, sharing, or transferring your personal information without your explicit consent.
  1. In order to provide you with products or services, we may share your information with our affiliates or business partners for purposes such as sending order notifications, promotional rewards, and marketing messages. These activities will only be carried out after obtaining your explicit consent, and we will provide options for you to unsubscribe or opt out.
  1. All acts of collecting, storing, using, and transferring personal information mentioned in this Policy are conducted in accordance with the laws and regulations of the People’s Republic of China, and are also subject to and aligned with relevant Vietnamese personal data protection regulations.

I.  How We Collect and Use Your Information

 

  1. When you use our products and/or services, we may need to collect and use your personal information under the following three scenarios:

(1) To provide you with the basic functions of our products and/or services, you must authorize us to collect and use necessary information. If you refuse to provide such information, you will be unable to properly use our products and/or services.

(2) To provide you with additional functions of our products and/or services, you may choose whether to authorize us to collect and use certain information. If you refuse to provide such information, you may not be able to use the relevant additional functions or may not achieve the intended effect of such functions, but this will not affect your normal use of the basic functions of our products and/or services.

(3) In the following situations, we may also collect your personal information through indirect means, including:

When you register or use our services, with your authorization, we may obtain additional personal information about you from third parties to prevent online fraud or other illegal or criminal activities.

 

  1. You understand and agree that:

(1)  We are committed to developing a diverse range of products and services to meet your needs. Because the types of products and services we offer are numerous, and the scope of products/services selected by different users varies, the specific basic/additional functions and the types and scope of personal information collected and used may differ. Please refer to the specific product/service functions for details.

(2)  To bring you a better product and service experience, we continuously improve our technologies. As a result, we may occasionally introduce new or optimized features, which may require the collection and use of new personal information or a change in the purpose or method of using personal information. In such cases, we will inform you separately by updating this Policy, via pop-up notifications, or page prompts, and clearly explain the purpose, scope, and method of use for the information involved. We will collect and use the information only after obtaining your explicit consent.

(3)  We attach great importance to the security of your personal information. Therefore, we adopt industry-standard and reliable security technologies and protection measures to safeguard your personal data. We collect and use your personal information only for the purposes stated in this Policy, and store it within the territory of the People’s Republic of China. In the event that cross-border data transfers are required, we will obtain your separate or explicit consent. If a security incident occurs that results in harm to your legal rights, we will assume legal responsibility in accordance with applicable laws and regulations.

(4)  If you explicitly refuse to provide the necessary information required for our core business functions, you may not be able to use our products or services properly.

If you have any questions, comments, or suggestions during this process, you may contact us through the various communication channels provided by MyMixue-TMS, and we will respond to you as soon as possible.

 

  1. We will collect and use your personal information to realize the following business functions under this Policy:

(1)  Helping You Become Our User:

To complete registration and account management during your use of our services, you are required to provide your name, mobile phone number, SMS verification code, device identifier, or other account-related information. By providing this information, you are deemed to have agreed to our collection and use of such data in accordance with this Policy.

(2)  Providing Supply Information Function:

When you need to view delivery orders or receive shipping and receiving notifications, we may collect location information (such as GPS coordinates, latitude and longitude, Bluetooth, base station data, etc.) to obtain your geographic location and push relevant supply or order information to you.

(3)  Order Acceptance and Order Management Function:

When you accept a transportation task via our products and/or services, we will generate corresponding order information. During this process, you will need to provide details such as the recipient’s name, address, and contact number and deliver the goods to the destination as required and confirm receipt.

We collect order numbers, creation time, arrival time, confirmation of receipt, etc., to help you complete transactions smoothly, ensure transaction security, query order information, and provide customer support and after-sales service.

If you are accepting or delivering goods on behalf of someone else, you must provide the relevant personal information of the carrier and ensure the legitimacy of the source of that information, as well as having obtained the authorization and consent of the relevant individual.

(4)  Order Inquiry and Management:

To facilitate your ability to check and manage your order information, we collect records and details of orders generated during your use of our services to present order content to you.

You may also fill in or select additional optional details (such as pickup time) to ensure accurate delivery of goods or services.

(5)  Transportation Completion Guarantee:

To complete the transportation task, you may choose a transportation method or relay delivery and authorize us to share the relevant order and necessary information with the selected third party.

To help us track delivery progress and provide you with after-sales support and dispute resolution, you authorize us to collect relevant transportation progress information from the selected third party or other logistics service providers.

(6)  Security Protection Services:

To enhance the security of your use of our services and those of our affiliates, protect the personal and property safety of you and others, and prevent security risks such as phishing, fraud, viruses, and cyberattacks, we may assess account and transaction risks by analyzing your account information, order information, device information, log data, location data, application list, usage environment, and data authorized by our affiliates or partners.

We may conduct identity verification, fraud detection, and security incident prevention. In accordance with the law, we will take necessary measures such as logging, auditing, analyzing, and responding to ensure network and information security.

 

Explanation of Additional Services:

Camera-Based Services: We may request access to your device’s camera on pages such as pickup, delivery confirmation, reviews, and image uploads. With your permission, you may scan order QR codes, take photos, and upload images related to the business scenarios you are clearly informed about.

Photo Album (Gallery/Media Library)-Based Services: We may request permission to access your photo or video album, which will allow you to upload photos or videos to our services once enabled.

Storage-Based Services: Upon enabling storage permission, we may read or write data on your device’s storage, such as images, files, and crash logs, to support features like content publishing and crash diagnostics.

 

Precise Location Access Services: We may request access to your location data (including approximate location based on base stations and precise location via GPS) on the homepage to provide more relevant pages and services, such as uploading transport routes or enabling navigation. You can disable this permission at any time in your device’s system settings.

 

You understand and agree that the above additional services may require you to enable permissions such as camera, album, storage, and location on your device to function properly. You may review and enable or disable each of these permissions at any time in your device’s system settings.

 

  1. Other Provisions

(1)  If the information you provide contains personal information of others, you must ensure that you have lawfully obtained the authorization of those individuals before providing such information to MyMixue-TMS.

(2)  If we intend to use the information for purposes not stated in this Policy, or use information collected for a specific purpose for a different purpose, or proactively obtain your personal information from third parties, we will obtain your prior consent.

(3)  Our dedicated security team will implement enhanced security measures for your personal information (including information obtained both directly and indirectly), such as sensitive data registration, encrypted storage, and access control. We will also verify the legality of any personal information obtained through indirect means.

  1. Exceptions to Consent Requirement

You fully understand and agree that we may collect and use your personal information without your prior authorization or consent under the following circumstances, and we may not respond to your requests for correction, deletion, account cancellation, or withdrawal of consent in such cases:

(1)  When it is related to national security or national defense;

(2)  When it is related to public safety, public health, or major public interests;

(3)  When it is related to criminal investigations, prosecutions, trials, or enforcement of judgments;

(4)  When it is necessary to protect your or others’ life, property, and other significant lawful rights and interests, and it is difficult to obtain your consent in a timely manner;

(5)  When the personal information is publicly disclosed by you yourself;

(6)  When the personal information is collected from lawful and publicly available sources, such as legitimate news reports, government disclosures, etc.;

(7)  When it is necessary for the conclusion or performance of a contract or other written agreement between you and us;

(8)  When it is necessary to ensure the safe and stable operation of our products and services, such as detecting and resolving malfunctions;

(9)  When it is necessary for legitimate news reporting;

(10)  When it is necessary for statistical or academic research purposes, and the information has been processed to be anonymized;

(11)  Other circumstances as prescribed by laws and regulations.

 

  1. Rules for the Use of Personal Information

(1)  We will process the personal information we collect in accordance with this Privacy Policy and for the purpose of delivering the functionalities of our products and services.

(2)  Please note that, in accordance with applicable laws, if we apply technical and administrative measures to process personal information in a way that prevents the data recipient from re-identifying individuals, or if we anonymize the collected information for the purposes of research, statistical analysis, and forecasting—such as improving MyMixue-TMS content and layout, supporting business decisions, or enhancing our products and services (e.g., using anonymized data for machine learning)—then the use of such processed data does not require separate notice to you or additional consent.

(3)  The information you voluntarily provide or authorize us to collect will continue to be used during your use of our products or services, unless and until you delete it or revoke authorization. If you cancel your account, we will promptly delete or anonymize your personal information, unless we are required by law or regulation to retain certain information, in which case we will store it appropriately in accordance with legal requirements.

(4)  If we cease operation of the MyMixue-TMS products or services, we will stop collecting your personal information and notify you in advance through announcements or other means. We will delete or anonymize the personal information related to the discontinued services and will no longer use it thereafter.

 

II.  How We Use Cookies and Similar Technologies

  1. No Cookies:
    At present, we do not use cookies or similar tracking technologies in our services.

 

III.  How We Share, Transfer, and Publicly Disclose Your Personal Information

1.  Sharing

We do not share your personal information with any organizations or individuals outside of the MyMixue-TMS service provider and its affiliated companies, except under the following circumstances and with appropriate security measures in place:

(1)  Sharing as required by law:
We may share your personal information externally as required by applicable laws and regulations, for purposes of litigation or dispute resolution, or in response to lawful requests from administrative or judicial authorities.

(2)  Sharing with your explicit consent:
We will share your personal information with third parties only after obtaining your explicit consent.

(3)  Sharing for better product or service delivery in specific business scenarios:
To provide improved products or services in various business contexts, our application may integrate SDKs or similar application programs provided by authorized partners.
We conduct strict security reviews on APIs and software development kits (SDKs) used by such authorized partners and require them to implement strict data protection measures. These partners must process personal information strictly in accordance with our entrusted purposes, service descriptions, this Privacy Policy, and any other relevant confidentiality and security measures.The SDKs integrated in our services include:

  1. Google Maps & Google Location SDK
    Purpose of Use: The app collects your location information in both foreground and background states, accesses the network to obtain map services, and uses storage permissions to save map cache. This supports location-related business scenarios such as showing your current location, providing navigation services for transportation tasks, and synchronizing order delivery information.
    Types of Personal Information Collected: Device location data (GPS location, WLAN access points, Bluetooth, Wi-Fi information, GNSS, cell tower data, gyroscope, accelerometer, and other sensor data), unique device identifiers (IMEI, IMSI, SSID, BSSID, MAC address), IP address, and installed application list.

(4)  Based on Contractual Agreements:
If a relevant agreement (including electronic agreements and platform rules) or legal document that you have entered into with us requires us to share your personal information with a third party, we will do so accordingly.

(5)  Based on Public Interest:
If applicable laws or regulations stipulate that personal information must be used for the public interest, we will share such information as required.

2.  Transfer

We will not transfer your personal information to any other company, organization, or individual, except under the following circumstances and only after implementing sufficient security measures:

(1)  Transfer with explicit consent:
We may transfer your personal information to another party only after obtaining your explicit consent.

(2)  Transfer during business changes:
In the event of a merger, acquisition, bankruptcy, liquidation, or other similar circumstances involving the MyMixue-TMS service provider, if the transfer of personal information is involved, we will require the new data processor to continue complying with this Privacy Policy. If the new entity cannot ensure such compliance, we will seek your renewed consent. The identity of the original personal information controller will also change accordingly.

(3)  Cross-border transfer:
If your personal information needs to be transferred outside the territory of the People’s Republic of China, we will strictly comply with the relevant laws and regulations of Vietnam, including obtaining your explicit consent and performing a cross-border data transfer impact assessment and other legally required procedures.

3.  Public Disclosure

We will only publicly disclose your personal information under the following circumstances:

(1)  With explicit consent:
We may publicly disclose your personal information only after obtaining your explicit consent.

(2)  To protect legitimate rights and interests:
If we determine that you have violated laws or seriously breached our agreements or platform rules, or to protect the safety of MyMixue-TMS, its affiliated users, or the public, we may publicly disclose relevant personal information—including details of the violation and the handling measures taken—with your prior consent.

Before any public disclosure, we will take protective measures in accordance with legal and regulatory requirements. In cases of legitimate requests for public disclosure, we will require the requesting party to provide corresponding legal documentation, such as an investigation notice, assistance request, or court order.

4.  Exceptions to Prior Authorization for Sharing, Transfer, or Public Disclosure of Personal Information

Under the following circumstances, we may share, transfer, or publicly disclose your personal information without obtaining your prior authorization or consent:

(1)  When it concerns national security or national defense;

(2)  When it is related to public safety, public health, or significant public interest;

(3)  When it is related to criminal investigations, prosecutions, trials, or the enforcement of court rulings or administrative actions;

(4)  When it is necessary to protect your or others' life, property, or other major lawful rights and interests, and it is difficult to obtain your consent;

(5)  When the personal information has been voluntarily disclosed by you to the public;

(6)  When the personal information is collected from legitimate public sources, such as lawful news reports or government disclosures.

Please note: In accordance with applicable laws, if we process your personal information using technical and administrative measures in such a way that the receiving party cannot re-identify individuals, the sharing, transfer, or public disclosure of such anonymized information does not require separate notice to you or your consent.

 

IV.  How We Protect Your Information

  1. Security Measures
    We have adopted industry-standard, reasonable, and feasible security measures to protect your personal information and prevent unauthorized access, public disclosure, use, modification, destruction, or loss. These measures include:Use of encryption technologies to enhance data security;Deployment of access control mechanisms to ensure only authorized personnel can access your information;Use of HTTPS and other encryption methods to secure data transmission;Regular security and privacy protection training for employees to raise awareness of personal data protection.
  2. Compliance with Network Security Requirements
    We have completed the assessment and registration in accordance with the Level III protection requirements of China's Cybersecurity Classified Protection Scheme.
  3. Data Security Management System
    We have established and improved a data security management system that enhances overall system security from multiple dimensions, including organizational structure, policy design, personnel management, and technical solutions. For sensitive personal information, we will notify you in advance and obtain your explicit consent as required by law and apply enhanced protection measures.
  4. Data Minimization and Retention
    We will take reasonable and feasible measures to avoid collecting irrelevant personal information. Your personal information will only be retained for the period necessary to fulfill the purposes stated in this policy, unless a longer retention period is required by law. Once the retention period expires, we will delete or anonymize your personal information in accordance with applicable laws.
  5. Information Security in Internet Environment
    Please understand that the internet is not an absolutely secure environment. While using MyMixue-TMS, we strongly recommend that you avoid transmitting personal information through unofficial channels. When interacting or sharing via our services, you may need to disclose your contact details or address to others—please safeguard your information and only provide it when absolutely necessary. If you discover that your personal information (especially your account credentials) has been compromised, please contact us immediately so we can take appropriate action.
  6. Security Alerts and Assessments
    We will periodically release information related to security risk warnings and personal data impact assessments. You may access such information via MyMixue-TMS announcements.
  7. Incident Response
    In the event of a personal information security incident, we will, in accordance with legal and regulatory requirements, promptly inform you of the basic situation of the incident, its potential impact, the emergency response measures we have taken or plan to take (e.g., data breach response plans), suggestions on how you can mitigate risks, and the remedial actions available to you. We will notify you via email, letter, phone, or push notification. If it is not feasible to notify individuals one by one, we will issue a public notice in a reasonable manner.
    In addition, we will report the incident and the handling outcome to the cybersecurity department of the Ministry of Public Security within 72 hours, as required by regulators.

 

V.  How You Can Manage Your Information

In accordance with applicable laws and regulations, you have the right to access and manage your personal information through the following means:

  1. Accessing Your Information
    You have the right to access your personal information (except where otherwise provided by laws and regulations). You may access or edit some of your personal data via the following methods:

Account Information:
To access or edit your basic account profile, open the MyMixue-TMS App, tap "My" → "Account Information" to enter the profile page.

Order Information:
You can view your order history and details on the main page of the MyMixue-TMS App by tapping the "Orders" menu at the bottom of the screen.

For other personal information generated during your use of our products or services, we will provide access in accordance with the arrangements described in subsection (8) of this section, titled "Responding to Your Requests".

  1. Correcting or Supplementing Your Personal Information
    If you find that the personal information we hold about you is inaccurate or incomplete, you have the right to request that we correct or supplement it. You may submit a request for correction or supplementation via the contact details provided in this Privacy Policy.
  2. Deleting Your Personal Information

You may delete your personal information through methods similar to those for querying your data. You have the right to request the deletion of your personal information under the following circumstances:

(1)  If our processing of your personal information violates laws or regulations;

(2)  If we collected or used your personal information without obtaining your explicit consent;

(3)  If our processing of personal information seriously breaches our agreement with you;

(4)  If you no longer use our products or services;

(5)  If we cease to provide products or services to you.

If we decide to honor your deletion request, we will also notify, to the extent reasonably possible, any third parties who have obtained your personal information from us and request that they promptly delete it, unless otherwise required by law or if those parties have obtained your separate authorization.

Please note: After you or we delete the relevant information, due to technical or legal limitations, the information may not be immediately removed from our backup systems. However, we will isolate it from any further processing and ensure it is deleted or anonymized once the backup is cleared.

  1. Changing the Scope of Your Authorization and Consent

Each business function may require certain basic personal information to operate properly (see Section II, Article 1 of this Privacy Policy). For the collection and use of additional personal information, you may contact us at any time to grant or withdraw your consent. You may also delete your personal information or disable relevant permissions in your device settings.

To enable or disable permissions, go to your device settings, find MyMixue-TMS in the application list, and view or modify permissions accordingly.

Please note:Enabling a permission means you authorize us to collect and use the relevant personal information in order to provide the corresponding serviceDisabling a permission means you withdraw your authorization, and we will no longer collect or use personal information under that permission, nor be able to provide the related service.

Your withdrawal of consent will take effect from the moment of withdrawal and will not affect any previous processing of personal information carried out based on your prior consent.

  1. Account Deletion
    If you wish to delete your account, you can do so by following the instructions provided in the MyMixue-TMS App. Navigate to the "My" page and tap "Delete Account", then follow the on-screen instructions to complete the process.

Once you have submitted a request to delete your account, we will stop providing services to you and will delete or anonymize your personal information in accordance with applicable legal and regulatory requirements.

  1.  Obtaining a Copy of Your Personal Information
    You have the right to request a copy of your personal information. You may contact us using the contact information provided in this Privacy Policy. We will respond to your request and provide the requested information within 15 working days.
  2. Restricting Automated Decision-Making by Information Systems
    In certain business scenarios, we may make decisions solely based on automated processing, including algorithms. If such a decision significantly affects your legal rights and interests, you have the right to request an explanation. We will comply with the law and provide an appropriate appeal mechanism, provided this does not infringe on trade secrets, the rights of other users, or the public interest.
  3. Responding to Your Requests

To ensure security, you may be required to submit a written request or otherwise verify your identity. We may ask you to undergo identity verification before processing your request.

We will respond to your request within 15 working days. If you are dissatisfied with our response, you may file a complaint through the MyMixue-TMS customer service channels.

We will be unable to respond to your request in the following circumstances:

(1)  Where it relates to national security or defense security;

(2)  Where it concerns public safety, public health, or major public interest;

(3)  Where it involves criminal investigation, prosecution, trial, or enforcement of judgments by judicial or administrative authorities;

(4)  Where there is sufficient evidence to show that the request is malicious or an abuse of rights;

(5)  Where responding to the request would cause serious harm to the legitimate rights and interests of you or others;

(6)  Where the request involves trade secrets.

VI.  How We Handle Minors' Personal Information

In this Privacy Policy, we assume that you possess the requisite civil capacity. If you are a minor, we require you to have your parent or legal guardian carefully read this Privacy Policy and obtain their consent before using our products or services or providing us with any information. Otherwise, you will not be able to create your own user account.

In accordance with Vietnamese laws, we do not process minors' personal information without the consent of a parent or guardian. When collecting and processing the personal information of minors, we will verify their age and strictly obtain parental or guardian consent as required by law.
